The city of Sitka in Alaska is considering changes to its critical areas ordinance in the wake of a series of landslides in 2015. The new ordinance would allow homeowners to waive the requirement for a geotechnical evaluation and any necessary mitigation in landslide areas, but would require them to sign a covenant with the city that would be tied to the deed of the land. The covenant would state that the homeowner accepts the risks and is protecting the municipality from financial liability. Subdivisions and high occupancy buildings would not qualify for the waiver option.
